1. Who we are

VibeStream ("VibeStream", "we", "us") is a music streaming platform operated by Stephen Turner trading as VibeStream, based in the United Kingdom. VibeStream allows users to listen to music, vote on tracks, build playlists, and upload their own original audio. These Terms of Service ("Terms") govern your use of https://vibestream.stream and any related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

2. Eligibility and accounts

You must be at least 13 years old to use the Service. If you are under the age of digital consent in your country, you may use the Service only with permission from a parent or guardian. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. One person, one account — operating multiple accounts to influence charts or platform features is prohibited (see Section 6).

3. Subscriptions and billing

VibeStream offers a free tier and an optional paid subscription ("Premium") billed monthly through our payment processor, Stripe. Premium features may include higher audio quality and increased upload allowances, as described on the pricing page at the time of purchase.

• Subscriptions automatically renew each month until cancelled.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period — you keep Premium access until then. We do not provide partial-period refunds unless required by law.
• Payments are processed by Stripe; we never see or store your full card details.
• We may change prices with reasonable advance notice; changes apply from your next billing cycle.

4. Your content: uploads, rights and declarations

You keep ownership of any audio you upload ("Your Content"). By uploading, you confirm, declare and agree that:

• Rights: You own the audio or hold all rights, licences and permissions needed to upload it and make it publicly available for streaming worldwide, and your upload does not infringe anyone's copyright, trademark, privacy or other rights.
• Origin label: Platform scope: VibeStream is exclusively for music created with AI tools — whether fully AI-generated or AI-assisted (e.g. your own lyrics or stems combined with AI-generated elements). You confirm every track you upload was made using AI tools as part of its creation. Recordings that are purely human-performed and human-produced without AI involvement are not permitted. Misrepresenting the origin of a track is a violation of these Terms.
• Explicit content: You will accurately flag tracks containing explicit lyrics or content using the provided option. Explicit material must still comply with these Terms; content that is illegal, hateful, harassing, or sexually exploitative is prohibited regardless of labelling.
• Licence to us: You grant VibeStream a worldwide, non-exclusive, royalty-free licence to host, store, transcode, reproduce, publicly perform and make available Your Content for the purpose of operating and promoting the Service (including displaying it on the platform and in charts). This licence ends when you delete your content or your account, except for reasonable backup/archival copies and for content already downloaded by other users.
• Prompts and metadata: Titles, artist names, prompts and descriptions you submit must not be misleading, infringing, or unlawful.

You may delete your uploads at any time, subject to Section 9 (takedowns).

5. Charts and play counting

The VibeStream Top 100 is a weekly chart that resets at 00:00 UTC each Sunday. A play counts toward the chart only when it is a genuine listen of at least 30 seconds by a logged-in user, with a maximum of one counted play per user per track per day. Chart positions may also reflect other signals such as upvotes as tiebreakers. Play counts are internal; only positions are displayed. We may exclude or discount plays that we reasonably believe to be artificial, automated, or manipulated, and may restrict accounts engaged in such activity.

6. Acceptable use

You agree not to:

• Upload content you do not have the rights to, or mislabel its origin or explicit status;
• Create or use multiple accounts, bots, scripts or automated tools to inflate streams, votes, chart positions or any metric;
• Circumvent rate limits, security controls, or attempt to access non-public parts of the Service;
• Use the Service to distribute malware, scrape it at scale, or interfere with its operation;
• Harass other users or impersonate VibeStream staff.

7. Reporting and enforcement

If you believe a track violates these Terms, use the report function or contact us at report@vibestream.stream We investigate all reports and may edit metadata, remove content, or suspend or terminate accounts that breach these Terms. Copyright complaints follow our separate DMCA & Copyright Policy.

8. Intellectual property of the Service

The VibeStream name, logo, design and software are owned by us and may not be copied or used without permission, except as needed to use the Service. Tracks on the platform are owned by their respective uploaders, not by VibeStream.

9. Copyright & takedowns

We respond to valid copyright complaints. See our DMCA & Copyright Policy for how to submit a takedown request or counter-notice. Repeat infringers lose their accounts.

10. Disclaimers and liability

The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. Tracks are uploaded by users and reflect their views and declarations, not ours. To the fullest extent permitted by law, VibeStream is not liable for indirect or consequential losses, or for loss of data, profits or goodwill arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law. The Service may be modified, interrupted or discontinued at any time, with or without notice.

11. Changes and termination

We may update these Terms; significant changes will be announced on the Service, and continued use after changes take effect constitutes acceptance. You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over any dispute arising from them. This does not affect mandatory consumer rights in your country of residence.
